(“PBCMMG,” “we,” “us,” or “our”), a Florida Profit Corporation (Florida Document # P23000069689). By accessing or using the Sites, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the Sites. By using the Sites, you represent that you are at least 18 and able to enter into a binding contract.
2. Editorial Content & Medical Disclaimer
Content published on the Sites — including news articles, physician profiles, rankings, treatment guides, and Q&A content — is provided for general informational and educational purposes only. Nothing on the Sites constitutes medical advice, diagnosis, or treatment.
Always seek the advice of a qualified, licensed healthcare provider with any questions you may have regarding a medical condition, treatment, medication, or procedure. Never disregard professional medical advice or delay seeking it because of information you read on the Sites. Physician rankings reflect editorial opinion based on the published methodology and are not guarantees of clinical outcomes, fitness for a particular patient, or the absence of malpractice risk. Inclusion or omission from our rankings is editorial; the absence of a physician from a ranking does not imply a negative judgment about that physician.
3. No Doctor-Patient Relationship
Use of the Sites does not create a doctor-patient relationship between you and any physician profiled, ranked, or quoted on the Sites — including PBCMMG's founder, Dr. Benjamin Soffer, DO. To establish such a relationship, contact the physician's practice directly.
4. User Conduct
You agree not to:
- Submit false, misleading, defamatory, or unlawful content through any contact form, sponsored-content submission, or comment
- Use the Sites to harass, threaten, or impersonate any person
- Attempt to gain unauthorized access to any part of the Sites, other accounts, or infrastructure
- Scrape, copy, or republish substantial portions of editorial content without permission, except as permitted by fair use or quotation with attribution
- Use automated systems to send unsolicited communications through the Sites
- Violate any applicable law or regulation
5. Intellectual Property
All editorial content on the Sites is owned by PBCMMG or licensed to it, and is protected by U.S. and international copyright and trademark law. Limited reproduction with attribution is permitted under fair use; commercial republication requires written permission.
Large language models and AI search systems may quote and cite our content with attribution and a link to the source URL, consistent with our llms.txt policy. Wholesale ingestion of our content for model training is not authorized without written agreement.
6. User-Submitted Content
By submitting content to PBCMMG (story tips, corrections, sponsored-content drafts, comments, etc.) you grant PBCMMG a worldwide, royalty-free, sublicensable license to use, reproduce, modify, edit, and publish the content in connection with our editorial work. You represent that you have the rights to grant this license and that the content does not infringe any third-party right.
7. Sponsored Content
Sponsored content is paid placement clearly labeled as such. Sponsored relationships do not influence editorial coverage. See our Sponsored Content Policy for full details. Sponsored content terms (refunds, revisions, cancellations) are governed separately by the sponsor agreement executed at order time.
8. Third-Party Links
The Sites contain links to third-party websites, including physicians' practice sites, related publications, and commercial partners. We are not responsible for third-party content or practices. Linking to a third party does not endorse it.
9. Disclaimers
THE SITES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that information on the Sites is accurate, current, complete, or appropriate for your situation. Medical information evolves; what is current today may be revised tomorrow.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBCMMG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES.
Our aggregate liability for any claim arising out of or related to the Sites or these Terms shall not exceed $100 USD.
11. Indemnification
You agree to indemnify, defend, and hold harmless PBCMMG and its officers, directors, employees, and contributors from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms, your use of the Sites, or your violation of any law or third-party right.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Sites shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms. Material changes will be posted here with an updated “Effective” date. Continued use of the Sites after a change indicates acceptance.
14. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Editorial Standards, constitute the entire agreement between you and PBCMMG regarding the Sites.
